Terms of service

Last updated: October 2026

These terms apply to all quotations issued by, and services provided by, 3DroneMapping (Pty) Ltd (registration number 2014/256136/07) ("3DroneMapping", "we", "us") unless a separate written agreement signed by both parties provides otherwise. By accepting a quotation or instructing us to proceed, the client agrees to these terms.

1. Quotations and orders

Quotations are valid for 30 days from the date of issue unless stated otherwise. Prices are stated in the currency shown on the quotation and exclude VAT or TAX unless indicated. A quotation becomes a binding order on written acceptance by the client, or on payment of the deposit, whichever is earlier. Any change to the area of interest, deliverables, accuracy specification, schedule or site conditions after acceptance may result in a revised price.

2. Payment

Unless otherwise agreed, a deposit is payable before mobilisation and the balance is payable on delivery of the final deliverables, within 30 days of invoice. We may withhold delivery of final data until payment is received. Overdue amounts attract interest at the prime lending rate of our bankers plus 2% per annum. Bank charges on international transfers are for the client's account.

3. Client obligations

The client is responsible for: providing accurate site information and boundaries; obtaining any landowner consents and access arrangements; identifying hazards, restricted areas and sensitive infrastructure on or near the site; and, where the client is the local entity, assisting with in-country permits and customs clearance for equipment. Delays caused by the client, site access, permits or security may be charged at our standby rates.

4. Permits, aviation and safety

Flight operations are conducted in accordance with applicable civil aviation regulations. We reserve the right to suspend or abort operations where weather, airspace restrictions, security or safety conditions make it unsafe or unlawful to continue. Where an authority withholds or revokes a permit through no fault of ours, the client remains liable for costs incurred to that point.

5. Deliverables and acceptance

Deliverables are described in the quotation. Accuracy and density figures are specifications under normal operating conditions and are verified against control points measured on site; they are not guaranteed under all terrain, vegetation or weather conditions. The client must notify us of any defect in a deliverable within 14 days of delivery, failing which the deliverable is deemed accepted. Our obligation for a defective deliverable is limited to re-processing or, where re-processing cannot cure the defect, re-surveying the affected area or refunding the portion of the fee attributable to it.

6. Limits of survey data

Survey deliverables record the site as it was measured on the day of capture. They are a representation of the ground, not a guarantee of it. Results can be affected by matters outside our control, including dense vegetation, water, steep or obscured terrain, weather, satellite positioning conditions, disturbance of ground control, control or boundary information supplied by the client or others, the coordinate system and geoid model used, and changes to the site after the survey.

Unless the quotation expressly says otherwise, deliverables are not a cadastral or legal boundary survey and are not certified by a registered professional land surveyor.

The client is responsible for deciding whether the deliverables are suitable for its intended use, and for independently checking critical levels, dimensions, positions and quantities before relying on them for design, construction, setting out, payment or legal purposes.

7. Intellectual property and data

On payment in full, the client receives a perpetual licence to use the deliverables for its own business purposes. We retain ownership of raw data, processing methods, flight plans, software and know-how. We may retain copies of data and deliverables for archival, quality and legal purposes, and may use anonymised or client-approved material for marketing and case studies. Third-party datasets or software incorporated in deliverables remain subject to their own licences.

8. Confidentiality

Each party will keep the other's confidential information confidential and use it only for the purpose of the project, save where disclosure is required by law or a regulator.

9. Liability

We are not liable for the client's project costs. This includes the cost of design, engineering, construction, earthworks, rework, delay, standing time, lost production and claims by the client's contractors or consultants, even where these follow from an error or inaccuracy in a deliverable.

To the extent permitted by law, our total liability arising out of or in connection with a project, whether in contract, delict or otherwise, is limited to the portion of the fee attributable to the affected deliverable or area, and will in no case exceed the fees paid for that project. We are not liable for indirect or consequential loss, loss of profit, or loss arising from the client's use of deliverables for purposes other than those described in the quotation. Nothing in these terms excludes liability that cannot be excluded by law.

10. Third-party claims

Deliverables are prepared for the client alone. No other person may rely on them without our written consent. The client indemnifies us against any claim by a third party, including contractors, consultants, landowners and authorities, that arises from the client's use of the deliverables or from the client passing them to others, except to the extent that the claim is caused by our gross negligence or wilful misconduct.

11. Time limit for claims

Any claim against us relating to a deliverable must be made in writing within 3 months of delivery of that deliverable. To the extent permitted by law, a claim not made within that period lapses.

12. Insurance

We maintain aviation liability insurance for our operations. Details are available on request.

13. Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control, including weather, civil unrest, government action, epidemic, or failure of transport or telecommunications. Timelines are extended accordingly.

14. Cancellation

A client may cancel an order in writing. Costs incurred and committed up to the date of cancellation (including mobilisation, travel, permits, shipping and subcontracted services) are payable, together with a cancellation fee of 10% of the remaining contract value where cancellation occurs after acceptance.

15. Website use

Content on this website is provided for general information. We make reasonable efforts to keep it accurate but give no warranty as to completeness. Third-party links are provided for convenience and do not imply endorsement.

16. Governing law

These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the High Court of South Africa, Western Cape Division, without prejudice to our right to bring proceedings in any other competent court.
